These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Tuquan Ltd, a company incorporated in Ghana ("Tuquan", "we", "us", or "our"), governing your access to and use of the Tuquan mobile application and website (collectively, the "Platform").

By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) to use the Platform. By using the Platform, you represent and warrant that you meet this eligibility requirement. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

• To access certain features of the Platform, you must register for an account by providing accurate and complete information, including a valid email address.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must notify us immediately at support@tuquan.com if you suspect any unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that are found to contain false, misleading, or incomplete registration information.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial travel planning purposes.

You agree not to:

• use the Platform for any unlawful purpose or in violation of any applicable law or regulation;
• reproduce, distribute, modify, create derivative works of, or exploit any content from the Platform without our prior written consent;
• use automated systems, bots, scrapers, or similar tools to access or extract data from the Platform;
• interfere with or disrupt the Platform's infrastructure, servers, or networks;
• attempt to gain unauthorised access to any part of the Platform or its related systems;
• impersonate any person or entity or misrepresent your affiliation with any person or entity;
• transmit any harmful, offensive, or unsolicited content through the Platform.

5.1 Visa and Entry Requirement Information

The visa and entry requirement data provided through the Platform is sourced from third-party data providers and is intended for general informational purposes only. Visa policies are subject to change at any time without notice. Tuquan does not guarantee the accuracy, completeness, or currency of this information. You are solely responsible for verifying current entry requirements with the relevant embassy, consulate, or official government source before making any travel arrangements.

5.2 Budget and Cost Estimates

All budget figures, cost estimates, and currency conversions provided through the Platform are approximations based on available market data and are subject to change. Tuquan does not guarantee that actual travel costs will correspond to displayed estimates. You should independently verify all pricing before making financial commitments.

5.3 AI-Generated Itineraries

Itineraries generated by the Platform are produced using artificial intelligence and are provided for planning and inspiration purposes only. They do not constitute professional travel advice. Tuquan does not endorse, verify, or guarantee the quality, availability, or suitability of any activity, accommodation, or service referenced in a generated itinerary.

• All content on the Platform, including but not limited to text, graphics, logos, software, and itinerary templates, is the property of Tuquan Ltd or its licensors and is protected by applicable intellectual property laws.
• Nothing in these Terms grants you any right, title, or interest in the Platform's intellectual property beyond the limited licence granted in Section 4.
• If you provide feedback, suggestions, or ideas regarding the Platform, you grant us a royalty-free, perpetual, irrevocable, worldwide licence to use, reproduce, and incorporate such feedback without any obligation to you.

The Platform may integrate with or link to third-party services, including calendar platforms, currency exchange providers, and visa data services. These third parties operate under their own terms and privacy policies, for which Tuquan has no responsibility. Your use of third-party services is at your own risk.

To the fullest extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content, including visa information, budget estimates, or AI-generated itineraries.

To the fullest extent permitted by applicable law, Tuquan Ltd and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, travel disruption, or visa denial, arising out of or in connection with your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim, or USD 50 where no payment has been made.

You agree to indemnify, defend, and hold harmless Tuquan Ltd and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your breach of these Terms; or (c) your violation of any applicable law or the rights of any third party.

• You may terminate your account at any time by requesting deletion through your account settings or by contacting us at support@tuquan.com.
• We reserve the right to suspend or terminate your access to the Platform at our discretion, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or the rights of others.
• Upon termination, your right to use the Platform ceases immediately. Sections 6, 8, 9, 10, 12, and 13 of these Terms shall survive termination.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of laws principles.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana. If you are a consumer in the European Economic Area, mandatory consumer protection laws of your country of residence may also apply.

We may update these Terms from time to time to reflect changes in our Platform, business, or applicable law. We will provide notice of material changes via email or a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of those Terms.

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Tuquan regarding the Platform and supersede all prior agreements.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
